End User License Agreement

Subject to your compliance with this Agreement, Rumble Tab grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Service for your own, non-commercial recreational use of keeping score, running groups, and playing along. That is the whole hand: we grant you nothing beyond it.

This is a license, not a sale. We and our licensors keep all right, title, and interest in and to the Service. You get to use it; you do not own it.

You must be at least 13 years old (or the minimum age of digital consent where you live, if higher) to use the Service, and old enough to form a binding contract. If you use the Service on behalf of a group or family, you represent that you are authorized to accept this Agreement for those participants you add.

Authentication is handled through our identity provider. You are responsible for the security of your account and for everything that happens under it. Give us accurate information, keep it current, and tell us promptly if you suspect unauthorized access. You may not share, sell, or transfer your account.

You agree not to, and not to help anyone else:

• break the law, or use the Service to harass, threaten, defame, stalk, or abuse anyone;
• post, upload, or share content that is illegal, hateful, sexually exploitative of minors, or that infringes someone else's rights;
• impersonate another person, or misrepresent your affiliation with anyone;
• reverse engineer, decompile, scrape, or attempt to extract source code or data from the Service, except where that restriction is prohibited by law;
• probe, disrupt, overload, or circumvent the security or rate limits of the Service;
• use bots or automated means to access the Service in a way that is not a supported client; or
• resell, rent, or commercially exploit the Service without our written permission.

There is no tolerance for objectionable content or abusive users at this table. Post it and it goes; do it twice and you go. We may investigate suspected violations and cooperate with law enforcement. Zero tolerance means zero: child sexual abuse material and credible threats of violence are reported and removed without warning.

You keep ownership of the content you create through the Service, including comments, names, avatars, and any images you upload (your “Content”). You grant Rumble Tab a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit your Content solely to operate, provide, and improve the Service, and to enforce this Agreement. This license ends when your Content is deleted, except for copies retained in backups for a reasonable period or as required by law.

You are solely responsible for your Content and represent that you have the rights to share it. Personal blocks let you hide another player's content from your own view; group owners moderate their own groups; and we may remove Content or suspend accounts that violate this Agreement.

Group owners act as the moderators of their own groups and may remove content or members within them. Above all groups, the Rumble Tab operator is the final backstop and may remove any content, suspend or terminate any account, or take down any group, at our discretion, to enforce this Agreement or the law.

Three tools stand between you and the worst of the room. A filter screens comments and names for objectionable language before they are posted. A flag on every comment and profile lets you report it to us from inside the app. A block hides a player and everything they have posted from your view, instantly and everywhere. Reports are acted on within 24 hours: offending content comes down and repeat offenders are ejected.

Some features, including hosting your own group, require a paid RumbleTab Club subscription. Subscriptions are billed through the platform you purchased on (for example, Apple's App Store or our web payment processor) and are subject to that platform's terms in addition to this Agreement.

• Subscriptions renew automatically for the same period at the then-current price until cancelled.
• You may cancel at any time through the platform that manages your subscription; cancellation takes effect at the end of the current billing period.
• Except where required by law or the platform's own policy, payments are non-refundable, and refunds (if any) are handled by that platform, not by us.
• We may change subscription prices or features on prospective notice; continued use after a price change means you accept it.

The Service, including its software, design, the deck and character artwork, badges, the Rumble Tab name and logo, and all related intellectual property, is owned by Rumble Tab or its licensors and is protected by law. Except for the limited license in Rule 1, this Agreement grants you no rights to our marks or materials. If you send us feedback or suggestions, we may use them without obligation to you.

The Service relies on third-party providers for authentication, hosting, media storage, payments, and notifications. Your use of those integrated services may be subject to their own terms and privacy practices. We are not responsible for third-party services, and their availability is not guaranteed by us.

Our handling of personal information is described in our Privacy Policy, which is incorporated into this Agreement by reference. By using the Service you consent to that handling.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that scores, standings, or data will always be accurate or preserved. The house is a scorepad, not a bank; back up anything you cannot lose.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUMBLE TAB AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR CAD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Rumble Tab and its operators from any claims, damages, and expenses (including reasonable legal fees) arising out of your Content, your use of the Service, or your breach of this Agreement or the law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if you breach this Agreement or if we discontinue the Service. On termination, the license in Rule 1 ends and you must stop using the Service; the sections that by their nature should survive (ownership, disclaimers, liability limits, indemnity, and governing law) survive.

We may update this Agreement from time to time. If we make material changes, we will take reasonable steps to notify you, such as posting the updated Agreement here with a new effective date. Your continued use of the Service after changes take effect means you accept the updated Agreement.

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts located in Ontario, Canada have exclusive jurisdiction over disputes arising out of this Agreement, except that either party may seek injunctive relief in any court of competent jurisdiction. If any provision is found unenforceable, the rest remains in effect.

The following applies when you obtain the Service from the Apple App Store. This Agreement is between you and Rumble Tab only, not with Apple, and Apple is not responsible for the Service or its content. Your license to use the app is a limited, non-transferable license to use it on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.

• Maintenance and support for the app are Rumble Tab's responsibility, not Apple's.
• To the extent any warranty is not effectively disclaimed, Apple may refund the app's purchase price to you (if any), and beyond that Apple has no warranty obligation for the app.
• Rumble Tab, not Apple, is responsible for addressing any claims relating to the app, including product-liability, legal or regulatory non-compliance, and consumer-protection claims.
• Rumble Tab, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and are not on any U.S. Government restricted-parties list.
• Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you as it relates to your license of the app.
